Allameh Mughniyeh Used Fiqh Muqarin to Interpret Quranic Injunctions

Allameh Muhammad Javad Mughniyeh used Fiqh Muqarin (comparative Fiqh) whenever he mentions a jurisprudential issue in his Al-Kashef Quran Exegesis, a Quran and Hadith expert said.
Hojat-ol-Islam Ebrahim Yaqubian added that Allameh refers to the views of both Shia and Sunni scholars in his interpretation.
He said that Allameh Mughniyeh wrote Al-Kashef some time around 1967 when the Middle East was witnessing the Arab-Israeli war and Lebanon’s civil war.
“It was one of the last books he wrote in his later years. Due to the events occurring at the time and the racist measures of the Zionist regime, Allameh, commenting on verses 63 to 66 of Surah Baqarah, warns that radical Jews are the main sources of chaos in the world, especially the Arab countries. This accurate view of Allameh at that time signifies his concern about sedition and discord in the Islamic world and his emphasis on the need for realization of Islamic unity.”
Hojat-ol-Islam Yaqubian noted that Allameh regarded the event of Mubahila (praying to God to destroy and banish the liars) and the prophecy about Jew’s method of government as two Quran miracles.
He referred to the literary aspects of Al-Kashef interpretation and said, “As Allameh, himself says, he does not mention complex literary issues which are not relevant to the message of the Quran nor topics that are merely scientific. He regards the message of the Quran as the most important thing and therefore does not see it necessary to analyze the literary aspects and eloquence of the Quranic verses.”
He pointed to Allameh’s focus on Islamic unity and said, “Allameh Mughniyeh believes that the Islamic Ummah and Muslims, regardless of their color or race, are linked with three main principle namely faith in God, the Quran and praying towards the Ka’aba. He believed that in order to materialize Islamic unity, Muslims should observe one another’s rights.”
Elsewhere in his remarks, Hojat-ol-Islam Yaqubian compared Al-Kashef with Al-Mizan Quran Exegesis by Allameh Tabatabaee and noted that the two have different approaches to interpreting the Quran.
“Al-Kashef is not a comprehensive Quran Exegesis whereas Al-Mizan discusses verses from various aspects and facets including philosophical, theological, social, etc.”
Hojat-ol-Islam Yaqubian is an instructor at Mashhad seminary and has authored a number of books on Islamic sciences including “Lawami-ul-Bayan” and “Sahw-un-Nabi”.
